法律英语,是专门用途英语中最具特色的一种,也是最难学的一种。有人说,法律英语本身就是一门“外语”,法律英语不论对于非英语国家的人还是对于英语国家的人来说,都是一门难懂的语言。 法律英语教学有别于普通英语教学,具有特殊用途英语教学的三大特征:第一,满足法律学习者的需求;第二,选择与法律专业和职业相关的内容;第三,选择与法律专业、职业相关活动中真实的词汇句法和语篇。因此,本教程的编写,充分考虑法律英语教学的实际需要,选择与专业、职业相关的活动中真实且具有时代气息的法律影像语言为语料,集中体现和贯彻“十一五”学位制度和法律硕士专业学位研究生“通过影像学法律、通过影像学英语”的英语教学理念,融“听说读写译”语言综合技能为一体,切实有效地提高学习者的实际操作能力。 目前国内有关法律英语的论著和教材名目繁多,有些偏重于法律概念的阅读,有些偏重于法律文书的撰写,还有些侧重于法律语篇的翻译。就我们所接触和掌握的法律英语教材而言,能够将法律影像与法律英语、普通英语与法律英语有机结合,通过大量影像故事中的实例,分析法学现象,讲解法理知识,讨论英美国家普通法系与我国大陆法系的差异,了解陪审员角色在法庭中由于不同法系所起的不同作用及原因,并提供实用性法律英语口语、法律英语翻译练习的教材目前并不多见。而能够适用于非英语专业研究生法律英语教学的专门教材更是微乎其微。有鉴于此,我们在广泛汲取和借鉴已有教材优势的基础上,总结具体的教学实践经验,编写了这本《高级法律英语影像教程》。与其他法律英语教材相比,本教程的设计和编写强调以下两个方面的特点: 其一,通过影像学习法律。法律与文学的概念发源于美国法学院的一场学术运动,继而演变成一种法学流派。按照波斯纳的观点,法律与文学可以有四个分支:作为(as)文学的法律;通过(through)文学的法律;有关(0f)文学的法律;文学中(in)的法律。本教程的总体规划受贺卫方、刘星、冯象等学者的叙事和论证方式,朱苏力、徐昕、胡明等专家从影像中寻求法学理念路径的启示,编写范畴主要涉及文学中的法律,聚焦英语电影及“60分钟访谈”故事中所折射出的一般法学知识。众所周知,法律似乎象征着一切教条、刻板、无情,而影像则代表浪漫、多彩的生活态度。但法律与影像都是对社会生活的反映,影像用光影声色生动形象地描写生活,法律用严谨的规则和逻辑编织生活。为了使法律英语教学与法律专业教学贴近,本教程参照法学专业与法律专业开设的重.占、必修课程,将不同年代具有代表性的各种法律问题的影像梳理归纳,以最贴近民众的方式,揭示正义的实现或实现正义的艰难,展现大众文化视野中的法律,纠正社会公众对法律的认知、理解的误解。因此,本教程成为法律人与社会公众实现沟通的另一种途径。

Legal education in different countries In addition to the qualifications required to become a practicing lawyer, legal education also encompasses higher degrees such as doctorates, for more advanced academic study. In many countries other than the United States, law is an undergraduate degree. Graduates of such a program are eligible to become lawyers by passing the countrys equivalent of a bar exam. In such countries, graduate programs in law enable students to embark on academic careers or become specialized in a particular area of law. In the United States, law is a graduate degree, which students embark upon only after completing an undergraduate degree in some other field (usually a bachelors degree), and is considered to be a graduate or professional school program. The undergraduate degree can be in any field, though most American lawyers hold bachelors degrees in the humanities and social sciences; legal studies as an undergraduate study is available at a few institutions. American law schools are usually an autonomous entity within a larger university. Faculty of law is another name for a law school or school of law, the terms commonly used in the United States. This term is used in Canada, other Commonwealth countries and the rest of the world. It may be distinguishable from law school in the sense that a faculty is a subdivision of a university on the same rank with other faculties, i.e. faculty of medicine, faculty of graduate studies, whereas a law school or school of law may have a more autonomous status within a university, or may be totally independent of any other post-secondary educational institution. In addition in some countries, including the United Kingdom, Canada and some states of Australia, the final stages of vocational legal education required to qualify to practice law are carried out outside the university system.
