书摘                                   书摘   The reasonable person is, of course, a creature of thelaw's imagination.  He or she is not the average ortypical person, but rather an idealized image of such aperson--a composite of the community's judgment as tohow the typical community member ought to behave ineach of the infinite variety of circumstances and activi-ties in which there is a potential or actual risk of harmto the actor or others. The test is not what the typicalrespectable citizen in fact does, nor what the majority ofthe COmmunity does, since the behavior (e.g. jaywalking)may fall below the community's standards of safety.   On the other hand, the reasonable person is notperfect or infallible.  She is permitted errors of judg-ment, mistakes in perception; she may even be momen-tarily distracted. She is human.  But such errors musthave been reasonable or excusable under the circum-stances; they must have been consistent with the exer-cise of ordinary care.   Attributes of the Reasonable Person.   Knowledge, Experience and Perception.  Tort liabilityfor physical harm is founded upon defendant's knowl-edge (actual or constructive) of the risk and of somedegree of probability that it will be realized (harm to theplaintiff).  In negligence (as distinguished from inten-tional torts), the actor does not desire the injuriousGonsequences of his conduct; he does not know that theyare substantially certain to occur, nor believe that theywill. There is merely a risk of such consequences suffi-ciently great that the ordinarily prudent person willanticipate them and guard against them.  Thus, thenormal actor (plaintiff or defendant) is charged with hisactual knowledge and perceptions, and also with certainbasic knowledge common to the community and withthe ability to observe and understand his environment.  Obviously, conduct must be judged in light of whatthe actor actually knows and observes, since the reason-able person always takes this into account.  If she bychance discovers that a product has a latent dangerousdefect, if she sees another vehicle approaching withoutlights at night, she must act accordingly, even thoughshe would not have been negligent in failing to discoveror observe these things.
